These Terms of Use govern your access to and use of the NovaraMD website and the services made available through it. Please read them carefully. By using this site you agree to be bound by them. If you do not agree, do not use the site.
Not Medical Advice, and Not for Emergencies
The content on this website is provided for general educational purposes. It is not medical advice, it does not create a physician-patient relationship, and it is not a substitute for evaluation by a licensed clinician who knows your history.
If you are experiencing a medical emergency, call 911 or go to the nearest emergency room. Do not use this website, the patient portal, or any message to a care team to report an emergency.
Eligibility
You must be at least 18 years old and physically located in the United States to use these services. By using the site you represent that both are true, and that any information you provide about yourself is accurate and complete.
How Care Is Delivered
Clinical services are delivered through a third-party telehealth platform operated by Heally. When you begin a visit, create an account, or complete a purchase, you leave this website and enter that platform, and your use of it is governed by Heally's own terms and privacy policy in addition to these terms.
Consultations, prescribing decisions, and pharmacy fulfilment are performed by independently licensed clinicians and pharmacies. NovaraMD does not practise medicine and does not direct any clinician's medical judgment.
Prescriptions Are Not Guaranteed
Submitting an intake form, booking a consultation, or paying for a plan does not entitle you to any particular medication. A clinician may decline to prescribe, may prescribe something different from what you requested, or may require lab work first. Treatment availability also varies by state.
Pricing, Payment and Refunds
Prices shown on this site are current at the time of publication and may change. Payment is processed on the Heally platform, and the cancellation and refund terms that apply to your plan are the ones presented to you there at checkout.
Where this site and the checkout disagree on price, the price at checkout governs.
Your Account
You are responsible for keeping your account credentials confidential and for all activity under your account. Tell us promptly at info@novaramd.com if you believe your account has been accessed without your permission.
Acceptable Use
You agree not to: provide false information during intake; use the services on behalf of another person without authorisation; resell, divert, or share prescribed medication; attempt to gain unauthorised access to any part of the site or platform; scrape, mirror, or reverse-engineer the site; or use the services for any unlawful purpose.
Intellectual Property
The text, graphics, layout, and other content on this site are owned by NovaraMD or its licensors and are protected by copyright and trademark law. You may view and print pages for personal, non-commercial use. Any other reproduction or distribution requires written permission.
Third-Party Links and Services
This site links to third-party services, including the Heally platform and LegitScript. Those services are operated independently, have their own terms and privacy policies, and are not under our control. We are not responsible for their content or practices.
Disclaimers
The site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or that any information on it is complete or current.
Statements on this site about clinical outcomes reference published trials of the named molecules and are not a promise of individual results.
Limitation of Liability
To the fullest extent permitted by law, NovaraMD will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of your use of the site. Nothing in these terms limits liability that cannot be limited by law, including liability for the professional negligence of a treating clinician, which rests with that clinician and their insurer.
Indemnity
You agree to indemnify and hold harmless NovaraMD and its officers, employees and agents from any claim arising out of your misuse of the site or your breach of these terms.
Governing Law
These terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law rules. Any dispute arising out of them will be brought in the state or federal courts located in Fulton County, Georgia, and you consent to that jurisdiction and venue.
This clause governs these website terms only. It does not limit where care is available: treatment is provided by licensed clinicians in all 50 states, and the care you receive is governed by the laws and licensing rules of the state you are in at the time of your visit.
Changes to These Terms
We may update these terms. The revision date at the top of this page shows when they last changed, and continued use of the site after a change means you accept the updated terms.
